THE PRINCIPLE OF EQUITABLE UTILIZATION IN INTERNATIONAL WATER LAW, ITS DEVELOPMENT AND ITS RELATION TO THE PROTECTION OF INTERNATIONAL WATERCOURSES
Customary international water law and its basic principles, the obligation not to cause transboundary harm and the principle of equitable utilization, are of fundamental importance in the use and protection of international watercourses. While the obligation not to cause transboundary harm is a general principle of international environmental law and its essence is presumably familiar to the informed reader, the principle of equitable utilization is specific only to the field of international water law. The article examines the relationship of this principle to the protection of international watercourses. It will show the historical development of international water law to its present form, discuss the content of the principle of equitable utilization and its application with special reference to the protection of international watercourses, and finally outline possible future developments in this area.
