THE LEGISLATIVE DEVELOPMENT OF THE LINEAR ACT OR ARE WE STILL IN THE RULE OF LAW?
At the end of 2023, Act No. 465/2023 Coll. was published in the Collection of Laws, amending Act No. 416/2009 Coll. on accelerating the construction of transport, water, energy and electronic communications infrastructure (the Linear Act), as amended, and other related acts.
In this paper, the authors discuss the development of the legislation and the current legal form of the Linear Act. They try to answer the question whether the content of the Linear Act (whether in its original or current form) contributes to the fulfilment of the basic requirements of the rule of law. That is, whether it fulfils the requirement that the legal order be concise, clear, efficient and logically organised. It critically assesses the law, particularly from the perspective of the public interest in environmental protection.
