MOST RECENTLY ON THE CONCEPT OF SUBSEQUENT PROCEEDINGS
The presented commentary deals with the most recent case law of Czech administrative courts in relation to subsequent proceedings under Act No. 100/2001 Coll., on Environmental Impact Assessment. The functional link between the additionally permitted construction and the project subject to the impact assessment process has proven to be key for assessing the nature of the proceedings as subsequent in the light of this case law. If the project cannot be technically operated without negative environmental impacts precisely because of such a construction, which is thus an essential part of it, the permitting procedure must be viewed as a subsequent proceeding within the meaning of § 3 letter g) of this Act.
