This paper aims to summarize and shed light on the legal aspects of the protection of trees growing outside forests. Although it may seem that there are only three provisions of the Nature and Landscape Protection Act and one implementing decree dealing with this issue and therefore there is nothing to write about, the reality is somewhat different. The author deals with aspects of both public law protection of trees, including liability for offences and including the procedural aspects of permitting felling, and aspects of private law (in particular property law and liability for damage. The article also contains findings obtained from the study of conceptual solutions to the legal regulation of the protection of trees growing outside forests contained in foreign legislation, which can serve as a source of inspiration for our legislation.
