REVIEW OF THE COMMENTARY ON THE SINGLE ENVIRONMENTAL OPINION ACT
The peer-reviewed publication, published in February 2024 by Wolters Kluwer ČR, is a commentary on Act No. 148/2023 Coll., on a Single Environmental Opinion. Its second part is a commentary on Act No. 149/2023 Coll., which amends some laws in connection with the adoption of the Act on a Single Environmental Opinion. These two laws brought conceptual changes to the Czech legal system with a very fundamental impact both for environmental law and for construction or mining law. The author collective of this commentary consists of three experienced authors who participated in the adoption of commented laws at the Ministry of the Environment. The authors present a single environmental opinion as a tool for process integration of state administration in the field of environmental protection. At the same time, they explain that this opinion represents a uniform basis for the procedure for planning permission according to the Building Act and for the procedure following the environmental impact assessment (EIA) process, namely to evaluate the effects of the plan on selected components of the environment and on the environment as a whole. It integrates statements, binding opinions (also referred to as consents, opinions, etc. in the „component“ regulations of environmental law), but also some administrative decisions issued according to component environmental legislation.
